Wrongful Termination.
In Ontario, your employer can fire you without reason so long as they provide you with notice. Notice can be paid or working.
For provincially regulated employees, a dismissal becomes wrongful when an employer:
→ Fires you without proper notice (i.e. none, or not enough)
→ Alleges they had cause to fire you, when in reality they did not
After a termination it is important to get legal advice quickly, even if you don't think your dismissal was wrongful. There are many ways a lawyer can help you deal with a termination. A lot will depend on what you are dealing with:
→ Review the circumstances of your dismissal to ensure that it doesn't violate Ontario's Human Rights Code or Occupational Health and Safety Act
→ Review the termination package offered by your employer to determine if you should ask for more money
→ If there is no contract or valid termination clause, or, if there are issues under the Code or OHSA, a lawyer can write to your former employer to demand more money
→ File a wrongful dismissal claim or other legal action to obtain proper notice and other damages from a court or tribunal
